The goal of Permitting and Regulation is to protect Palm Beach
County's natural resources though environmental assessment, permitting, compliance
and land development review activities. Prior to site development, ERM provides
comments to the Planning Zoning and Building Development Review Officer (DRO)
to ensure that the proposed development is consistent with environmental regulations.
ERM also reviews plans submitted to various permit centers operated by the Planning,
Zoning & Building Department providing increased customer service. ERM responds
to citizen complaints and performs environmental inspections to ensure compliance
with related laws, regulations and codes. A Prohibited Vegetation removal incentive
program is also conducted by ERM staff. A number of informational pamphlets
and resource materials are available for your use. The following programs, Ordinances,
Unified Land Development Codes (ULDC), and Florida Administrative Codes (FAC)
are managed by this division:
ULDC Article 17.C.7. and Article 10.E. The GNRPB holds hearings as necessary to enforce ULDC Articles 14.A., Sea Turtle Protection and Sand Preservation; B., Wellfield Protection; C., Vegetation Preservation and Protection; and D., Prohibited Invasive Non-Native Vegetation Removal; Article 4.D. Excavation; Ordinances 2004-050, Stormwater Pollution Prevention; 93-3, Water and Irrigation Conservation; 2003-20, Petroleum Storage Systems; and 2003-21Petroleum Contamination Cleanup Criteria.
The GNRPB is composed of seven members appointed by the Board of County Commissioners. The membership consists of a professional engineer registered in the State of Florida, an attorney licensed to practice in Florida, a hydrologist, a citizen possessing expertise and experience in managing a business, a biologist or a chemist, a concerned citizen and a member of an environmental organization.
The GNRPB has the powers and duties to adopt rules of procedure:
issue subpoenas; take testimony under oath; issue orders having the force of
law commanding whatever steps necessary to achieve compliance with violations;
lien property; and, assess administrative fines and penalties.
